Emily's litigation work spans a variety of technologies, from pharmaceuticals and medical devices to computer software.
Emily Rich focuses her practice on intellectual property (IP) litigation. She has experience in many stages of litigation, including pre-lawsuit investigations, initial pleadings, fact and expert discovery, depositions, claim construction, and motion practice.
Emily served as a law clerk on the U.S. Court of Federal Claims, where she handled complex civil cases against the U.S. government involving patent infringement, Fifth Amendment takings, bid protests, government contracts, and vaccine injuries. As a law clerk, Emily attended oral hearings and assisted in preparing for those on patent infringement disputes, including claim construction hearings, invalidity challenges, and discovery disputes.
While attending law school, Emily externed for the Honorable Alice M. Batchelder of the U.S. Court of Appeals for the Sixth Circuit. She was a member of the Akron Law Review, where her student note on subject-matter eligibility for medical diagnostics was selected for publication. Prior to law school, Emily worked as a business development professional in the legal field. She also completed legislative internships for the U.S. Senate and the Utah State Legislature.
Emily is a member of the Giles Rich American Inn of Court, where she serves as the secretary and historian of the Inn.
