State Route 99 Bored Tunnel Dispute

Superior Court of Washington, Thurston County
Represented a major equipment manufacturer in contract and insurance coverage litigation arising out of damage to “Bertha,” the 57-foot diameter tunnel boring machine used to bore a 9,270-foot highway tunnel beneath downtown the City of Seattle.

Product Liability

Daniel v. The Coleman Company

Double wrongful death carbon monoxide exposure product liability case arising from use of propane radiant heater inside camper during hunting trip. After a two week trial, the jury delivered a defense verdict, finding the heater reasonably safe and not defective in design and warnings. Affirmed by the Ninth Circuit.

Zimmerman v. Llyod's Register Energy Americas, Inc.

Defense of asset integrity, risk based inspection engineering firm in seven death petroleum refinery litigation.

Trinity Glass International Inc. v. LG Chem Ltd.

Defense of international chemical company in $50 million breach of contract, breach of warranty and fraud case involving polymer resin. Court granted client’s motion for partial summary judgment dismissing more than $25 million of plaintiffs’ claimed damages and dismissing all of plaintiffs’ tort-based claims.

Defense of commercial paint spray equipment manufacturer in personal injury/product liability action involving severe facial fractures and claimed brain injury.
