Erika guides clients through the dynamic and often unpredictable challenges presented by federal and state environmental law and regulations, real estate issues, permitting, regulatory compliance, and water rights.

Natural resources lawyer Erika Malmen advises mining, industrial, agribusiness, energy, forestry, utility, resort, municipal, and developer clients with a particular focus on public lands permitting and development. Erika has experience with the alphabet soup of state and federal environmental statutes and regulations, including the National Environmental Policy Act (NEPA), Federal Land Policy and Management Act (FLPMA), the Mining Laws of 1872, National Forest Management Act (NFMA), and Clean Water Act (CWA), and others. Clients trust her to represent them in front of administrative tribunals (such as the Interior Board of Land Appeals) and in traditional state and federal court litigation.

Knowing and understanding the public and governmental scrutiny her clients often encounter, she works with government agencies and often public relations consultants and engineers to clearly communicate her client's messaging and provide the advice necessary to secure permits for a successful project.

As part of her client advocacy, Erika maintains productive relationships with agencies, rulemaking authorities, and lawmakers. Her counsel is informed by her experience serving as a lawyer for the U.S. Department of the Interior.
