On May 13, 2024, the Commission issued Order No. 1977 revising its regulations governing applications for permits to site electric transmission facilities under Section 216 of the FPA to account for amendments to Section 216 in the Infrastructure Investment and Job Act (IIJA). On June 12, 2024, the Louisiana Public Service Commission, the Pennsylvania Public Utilities Commission, the New York State Public Service Commission, and several public interest organizations filed requests for rehearing of Order No. 1977 arguing certain aspects of the final rule were improper. | E-2 | RM22-2-000 | Compensation for Reactive Power Within the Standard Power Factor Range. On March 21, 2024, the Commission issued a Notice of Proposed Rulemaking to revise its pro forma open-access transmission tariff (OATT) to prohibit transmission providers from including in their transmission rates any charges associated with the supply of reactive power within the standard power factor range from generating facilities. The Commission also proposed to remove from its pro forma large and small generator interconnection agreements the requirement that a transmission provider pay an interconnection customer for reactive power within the standard power factor range if the transmission provider pays its own or affiliated generators for the same service. On April 25, 2020, the Commission initiated a Section 206 investigation into the reactive power rates provided by Fern Solar LLC’s (Fern) 100 MW photovoltaic electric generating project located in Tarboro, North Carolina. On April 13, 2023, an administrative law judge issued an initial decision on a fully litigated record. | E-4 | Association of Businesses Advocating Tariff Equity, et al. v. Midcontinent Independent System Operator, Inc. et al. Arkansas Electric Cooperative Corporation, et al. v. ALLETE, Inc., et al. On November 12, 2013, the Association of Businesses Advocating Tariff Equity, et al., filed a section 206 complaint requesting that the Commission (1) reduce the base return on equity used in the MISO Transmission Owners’ (MISO TOs) and ATC’s formula transmission rates, (2) institute a capital structure in which the assumed equity component does not exceed 50%, and (3) eliminate the return on equity (ROE) adders approved for International Transmission Company d/b/a ITC Transmission and Michigan Electric Transmission Company, LLC at that time, including those for being a member of a regional transmission organization and for being an independent transmission owner. Alternatively, the complainants requested that the Commission find that the respondents’ existing base ROEs are unjust and unreasonable and assign all of the issues to a settlement judge for a settlement process. On October 16, 2014, the Commission issued an order establishing settlement and hearing judge procedures and establishing a refund effective date. Following a series of unsuccessful settlement conferences, the chief judge issued an order terminating the settlement procedures and designating a judge to preside over the evidentiary hearing. On February 12, 2015, Arkansas Electric Cooperative Corporation, et al., filed a Section 206 complaint requesting that the Commission find that the MISO TOs current base ROE is unjust and unreasonable and should be adjusted to the proposed ROE, and a request that the complaint be consolidated with the proceeding in Docket No. EL14-12. On June 24, 2015, the chief judge denied the motion to consolidate the proceedings and issued a separate order designating a presiding administrative law judge and establishing an initial decision deadline. On May 23, 2024, FERC denied a complaint by Lackawanna Energy Center LLC (Lackawanna) against PJM Interconnection, L.L.C. (PJM) that challenged PJM’s refusal to reimburse Lackawanna for lost opportunity costs incurred after being curtailed due to a transmission line outage. On June 21, 2024, Lackawanna filed a request for rehearing, and FERC issued a notice of denial by operation of law on July 22, 2024. Agenda item E-12 may be an order on rehearing. |

(PJM) submitted reforms to the Reliability Pricing Model (RPM) and related rules in its OATT and Reliability Assurance Agreement Among Load Serving Entities designed to enhance PJM's resource adequacy risk modeling and capacity accreditation processes and enhance testing requirements of capacity resources. FERC approved these reforms on January 30, 2024. The Advanced Energy Management Alliance; the Independent Market Monitor for PJM; the American Clean Power Association; the Solar Energy Industries Association; and American Municipal Power, Inc. requested rehearing of FERC's order approving PJM's reforms. On September 29, 2020, Idaho and New Sweden Irrigation Districts (Districts) submitted an application for an original license authorizing the Districts to construct and operate the 2.49 MW County Line Road Hydroelectric Project, located on the Snake River in Bonneville and Jefferson Counties, Idaho. The Final Environmental Assessment was released on February 10, 2023, and the Executed Programmatic Agreement was provided on March 20, 2024. Item H-1 may be an order on this license application. |

On March 13, 2009, Pacific Gas and Electric Company (PG&E) submitted its application to surrender its project license and to decommission and remove or modify several project features for the Kilarc-Cow Creek Hydroelectric Project, located on Old Cow Creek, South Cow Creek, and tributaries in Shasta County, California. The Final Environmental Impact Statement (EIS) was released on August 16, 2011, and a Supplemental Environmental Assessment (EA) was released on December 3, 2021, to address changes that have occurred at the project since 2011. On November 2, 2023, MountainWest Overthrust Pipeline, LLC (Overthrust) submitted an application for a certificate of public convenience and necessity authorizing Overthrust to construct and operate its Westbound Compression Expansion Project, which would allow Overthrust to provide an additional 325,000 dekatherms per day of firm natural gas transportation service from two existing interconnects to a new delivery point near Overthrust’s existing Roberson Compressor Station beginning with the 2025/2026 winter heating season. On September 15, 2023, Bison Pipeline LLC filed an application requesting authorization to abandon 300,000 dekatherms per day of existing unsubscribed capacity by lease to Wyoming Interstate Company (WIC). Also on September 15, 2023, Northern Border Pipeline Company filed an application for a certificate of public convenience and necessity requesting authorization for its Bison Xpress Project, located in North Dakota, to replace and expand compression facilities at Northern Border’s existing Arnegard, Manning, and Glen Ullin Compressor Stations. On September 18, 2023, WIC and Fort Union Gas Gathering (FUGG) filed a joint application for a certificate of public convenience and necessity requesting authorization to lease 300,000 dekatherms per day of capacity on the Northern Border, Bison, and FUGG pipeline systems. In addition, FUGG requested a limited jurisdiction certificate authorizing it to allow WIC to transport interstate natural gas on FUGG’s gathering system without subjecting FUGG’s gathering operations to the Commission’s Natural Gas Act jurisdiction. On October 4, 2023, Cameron Interstate Pipeline, LLC filed an application for a certificate of public convenience and necessity requesting authorization to construct and operate the Holbrook Expansion Project on its existing Cameron Interstate Pipeline system located in Calcasieu Parish, Louisiana. The project consists of two additional compressor units and appurtenant facilities, which will provide up to 1,079,000 dekatherms per day of firm natural gas transportation capacity used for Cameron LNG’s natural gas liquefaction and liquified natural gas export facility in Cameron Parish, Louisiana.
