Ct. – Los Angeles Cnty.): Proposition 65 action alleging that B&C Roasted Seaweed products sold by Defendants contain lead. Complaint. Greene v. Gerber Prods. Co., No. 1:16-cv-1153 (E.D.N.Y.): Putative class action asserting violations of Ohio and  North Carolina's consumer protection statutes and claims of fraudulent concealment, intentional misrepresentation, negligent misrepresentation, and unjust enrichment. Fla.): Putative class action asserting violation of Florida's Deceptive and Unfair Trade Practices Act and a claim for unjust enrichment, based on the allegation that Defendant misleadingly markets its Creamy Supreme Milk Chocolate frosting product as containing milk, although it does not contain any milk. Complaint. Pappas v. Chipotle Mexican Grill Inc., No. 3:16-cv-612 (S.D. Cal.): Putative class action asserting violations of California's CLRA, FAL, and UCL. Plaintiff contends Defendant has misleadingly promoted its food products as healthy, although the products have never been free of GMOs. Complaint. Whitaker v. Herr Foods, Inc., No. 160300763 (Ct. of Common Pleas – Philadelphia Cnty.): Putative class action asserting violation of the Pennsylvania Unfair Trade Practices and Consumer Protection Law and claims for breach of express warranty, breach of contract, fraud, negligent misrepresentation, and unjust enrichment. Plaintiff alleges that Defendant falsely represents its snack food products as being "All Natural" or containing no preservatives or MSG, when in fact, the products contain a host of synthetic and highly processed ingredients, chemical preservatives, and GMOs. Complaint.
